The study for reviewing criteria on allocation of agriculture land
to the community in the national reserved forest

Abstract
This research studies the criteria of land allocation for the community and related laws and policies;
the conditions, problems, and obstacles of land allocation; and the economic, social and cultural conditions
of the community in the national reserved forest. This research aims to analyse the limitations and obstacles
in the implementation of the policy on land allocation for the community and to propose guideline for
improving the criteria of land allocation for the community.
The evaluation of implementation of the policy reveals that the allocation of land in combined
plots form without ownership is appropriate. However, there are problems in implementing the policy
including the lack of readiness in terms of land to be allocated, criteria of land allocation, government
agencies, and farmers, the processes are delayed and not suitable for the policy implementation, and the
operation fails to achieve its intended objectives.
The research suggests that the criteria of land allocation for the community in the national reserved
forest should be improved. Frist, the land right should truly belong to the community. In the first phase,
the Sub-District Administrative Organisation may be permitted. In the long run, the National Reserved Forest
Act, 1964 should be reviewed to ensure community rights or to specify to be a grouping as a cooperative.
Second,
there should determine the qualification of those who deserve to be allocated land by considering the
farmers who are able to use the land effectively under the constraints of resources. Third, the land should
be also used for other activities related to agriculture operated by community and benefit the community
and the environment, and the promotion should be changed from promoting self-reliance to promoting
career development and marketing comprehensively. Moreover, there should establish the criteria for the
community to have a systematic approach or work plan on land management. Fourth, the community
should be allowed to use the land permanently if the rules and conditions are not violated, and there
should determine the rate of compensation payment appropriately by comparing with the compensation
for the use of land in other types of land and the right received. Fifth, the role of the community in land
use management and monitoring should be established.
