Abstract
The purposes of this research were to comparatively analyze the land legal status in
Thailand with the FSC international forest management certification standard and formulate
policy recommendations on the land legal status suitable for promoting the international
commercial wood plantation management standard certification. Both primary and
secondary data including in-depth interviews derived from representatives of relevant
agencies were collected to obtain five groups of information including (i) the FSC forest
management certification standard dealing with the land legal status in forest management
certification and covering principles, criteria and indicators; (ii) the land legal status of
commercial wood plantation in Thailand were classified into two groups of lands with the
possibility to obtain a forest management certification and land with low probability or lack
of legal clarity to obtain forest management certification; (iii) the Corrective Action Requests
(CARs) of previous forest management certification audits in Thailand revealing the issues of
land legal status; (iv) the intents or scopes of commercial wood plantation management
standards relating to the land legal status; and (v) the results of a comparative analysis
between the land legal status in Thailand and the intents of the FSC forest management
certification standard. These data were used to formulate six policy recommendations on
the land legal status suitable for promoting the international commercial wood plantation
management standard certification including 1) determine the promotion of the
international commercial wood plantation management standard certification as an
important and prescribed in national and organizational levels of policies and plans; 2)
determine and develop government organizations to play a role in solving the land legal
status inconsistency with the intents or scopes of international commercial wood plantation
management standards; 3) develop and improve laws and regulations relating to land in
order to promote the international commercial wood plantation management standard
certification with sustainability and balance with economic, social and environmental
development; 4) organize and resolve conflicts arising from the occupying or use of state
forest lands with appropriately and fairly under the provisions of relevant laws and taking
into account the impact on forest ecosystems and environment from the use of forest land
to be completed within the time-limited; 5) expedite the resolution of the legal land
boundaries overlapping problem of each legal type of land, both state and private land and
